Interesting enough the people behind The Pirate Bay and similar Swedish organizations, like <span lang=\"EN\">Pirate Party leader Rick Falkvinge, use the freedom of information argument to defend piracy. As he <a href=\"http:\/\/www.thelocal.se\/17520\/20090211\/\">states<\/a>:<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;margin:0;\"><strong><span lang=\"EN\"><span style=\"font-size:small;font-family:Times New Roman;\">\u00a0<\/span><\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;margin:0;\"><span lang=\"EN\"><span style=\"font-size:small;font-family:Times New Roman;\">\u201c<\/span><span style=\"font-size:small;\"><span style=\"font-family:Times New Roman;\"><em>On the one side, there is the public. Every human with access to the Internet has received fingertip round-the-clock access to all of humanity&#8217;s collective knowledge and culture. This is a fantastic leap ahead for mankind \u2013 much larger than when public libraries arrived 160 years ago, and comparable to how society changed with the arrival of the printing press.<br \/>\nOn the other side, there are the current people in power, who would like to harness this power to build a surveillance machine \u2013 collecting information about regular Joes, and actively preventing the free exchange of ideas \u2013 that would make George Orwell look like a cheery, skipping optimist. Many powerful institutions are pulling in this direction.\u201d<\/em><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span lang=\"EN\"><span style=\"font-size:small;font-family:Times New Roman;\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span lang=\"EN\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">The trial is already been <\/span><\/span><a href=\"http:\/\/www.thelocal.se\/17520\/20090211\/\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">called<\/span><\/span><\/a><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\"> the \u2018political trial of the century\u2019 and seems to be going <\/span><\/span><a href=\"http:\/\/www.thelocal.se\/17640\/20090217\/\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">favorably<\/span><\/span><\/a><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\"> for the Pirate Bay. Via <\/span><\/span><a href=\"http:\/\/www.boingboing.net\/2009\/02\/17\/steal-this-move-pira.html#previouspost\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">BoingBoing<\/span><\/span><\/a><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\"> I discovered that in honor <\/span><\/span><\/span><span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">of the trial of the Pirate Bay&#8217;s founders, the people behind the documentary series <\/span><\/span><a href=\"http:\/\/en.wikipedia.org\/wiki\/Steal_This_Film\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">\u2018Steal this film\u2019<\/span><\/span><\/a><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\"> have released a new trial edition of what is eventually to become a movie on intellectual property right and file sharing. You can download it from their <\/span><\/span><a href=\"http:\/\/stealthisfilm.com\/trial\/\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">website<\/span><\/span><\/a><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">. The first part of this documentary can be found in many places, including <\/span><\/span><a href=\"http:\/\/video.google.com\/videoplay?docid=-4116387786400792905&amp;q=steal+this+film&amp;total=1999&amp;start=0&amp;num=10&amp;so=0&amp;type=search&amp;plindex=0\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">here.<\/span><\/span><\/a><span style=\"font-size:small;\"><span style=\"font-family:Times New Roman;\"><span style=\"color:#515151;\"> <\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">This is actually a very interesting documentary (series), which follows the same idea as the remix documentary <em>RiP<\/em> I wrote about <\/span><\/span><a href=\"http:\/\/openreflections.wordpress.com\/2008\/12\/12\/remix-manifesto\/\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">before<\/span><\/span><\/a><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">, putting raw (searchable) <\/span><\/span><a href=\"http:\/\/footage.stealthisfilm.com\/\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">footage<\/span><\/span><\/a><span style=\"font-size:small;\"><span style=\"font-family:Times New Roman;\"><span style=\"color:#515151;\"> and snippets of what is to become the final documentary online, together with more or less finalized versions of the documentary (like a sort of preprint in scholarly communication lingo).<\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\">\u00a0<img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-372\" title=\"steal_this_film\" src=\"http:\/\/openreflections.wordpress.com\/wp-content\/uploads\/2009\/02\/steal_this_film.png\" alt=\"steal_this_film\" width=\"400\" height=\"225\" srcset=\"https:\/\/openreflections.org\/wp-content\/uploads\/2009\/02\/steal_this_film.png 640w, https:\/\/openreflections.org\/wp-content\/uploads\/2009\/02\/steal_this_film-300x169.png 300w, https:\/\/openreflections.org\/wp-content\/uploads\/2009\/02\/steal_this_film-533x300.png 533w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\">\u00a0<\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\">\u00a0<\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">The documentary follows roughly the same logic as Lawrence Lessig\u2019s book <\/span><\/span><a href=\"http:\/\/www.time.com\/time\/business\/article\/0,8599,1851241,00.html\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">Remix,<\/span><\/span><\/a><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\"> arguing that it is of no use to criminalize a whole generation of downloaders or \u2018pirates\u2019 for that matter, and that it is much more productive to search for an alternative solution to this problem, or in other words to search for an alternative business model that will sustain the free flow of cultural goods and information. The documentary includes a very nice book history analogy, referring not only to the coming of the printing press but also to historical notions of book piracy, with contributions from famous book historians like Elisabeth Eisenstein and Robert Darnton. The documentary includes interviews with other renowned figures like Yochai Benkler, and Rick Prelinger from the <\/span><\/span><a href=\"http:\/\/www.archive.org\/details\/prelinger\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">Prelinger Archive<\/span><\/span><\/a><span style=\"font-size:small;\"><span style=\"font-family:Times New Roman;\"><span style=\"color:#515151;\">. I like the way he makes the following statement near the end of the documentary:<\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">\u00a0<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><em><span style=\"color:black;\"><span style=\"font-size:small;\"><span style=\"font-family:Times New Roman;\"><span style=\"color:#515151;\">\u201cI think we need to have a broad conversation that is probably going to be an international conversation where people who make things and people who use things, I am talking about cultural works, sit together and think about what kinds of rules best serve these interests. I don\u2019t know that we are going to agree, but I think we need to ask a little bit more about utopia, we need to really figure out what kind of a world we would like to live in and then try to craft regulations to match that. Being reactive doesn\u2019t cut it.\u201d<\/span><\/span><\/span><\/span><\/em><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><em><span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\">\u00a0<span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-374\" title=\"still-from-movie-from-prelinger-archive\" src=\"http:\/\/openreflections.wordpress.com\/wp-content\/uploads\/2009\/02\/still-from-movie-from-prelinger-archive.jpg\" alt=\"still-from-movie-from-prelinger-archive\" width=\"500\" height=\"375\" srcset=\"https:\/\/openreflections.org\/wp-content\/uploads\/2009\/02\/still-from-movie-from-prelinger-archive.jpg 640w, https:\/\/openreflections.org\/wp-content\/uploads\/2009\/02\/still-from-movie-from-prelinger-archive-300x225.jpg 300w, https:\/\/openreflections.org\/wp-content\/uploads\/2009\/02\/still-from-movie-from-prelinger-archive-400x300.jpg 400w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/span><\/span><\/span><\/span><\/em><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\">\u00a0<\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\">\u00a0<\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">I saw Rick Prelinger speak at a <\/span><\/span><a href=\"http:\/\/www.debalie.nl\/dossierartikel.jsp?dossierid=208416&amp;articleid=212725\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">Creative Commons conference<\/span><\/span><\/a><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\"> in de Balie in Amsterdam a year ago, together with speakers like Kenneth Goldsmith from <\/span><\/span><a href=\"http:\/\/ubu.com\/\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">Ubuweb<\/span><\/span><\/a><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\"> and people from <\/span><\/span><a href=\"http:\/\/www.fabchannel.com\/\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">Fabchannel<\/span><\/span><\/a><span style=\"font-size:small;\"><span style=\"font-family:Times New Roman;\"><span style=\"color:#515151;\">, discussing alternative business models. The panel I attended discussed amongst others:<\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">\u00a0<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span style=\"color:black;\"><span style=\"font-size:small;\"><span style=\"font-family:Times New Roman;\"><span style=\"color:#515151;\"><span>\u00a0<\/span>\u201c\u2026<em>the public content zone beyond that of user-generated-content: the possibilities and problems related to making professionally produced cultural productions publicly available on the internet. What kind of revenue models exist for that? How is the public interest in accessibility squared with the need of professionals to make a living? What new and alternative distribution models emerge for professional cultural producers and cultural institutions?\u201d<\/em><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">\u00a0<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span style=\"color:black;\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">I think this is the important discussion, as Rick Prelinger also stated above, we need to find a solution for both producers and consumers of cultural and knowledge products and content. For as the documentary and Lessig\u2019s books also show, the potential value of the free availability of all this information on the Internet is huge, stimulating new cultural creativity and knowledge production in. Next to that this development can even be very beneficial for society and the economy in general. In fact, as a recent <\/span><\/span><a href=\"http:\/\/www.ez.nl\/dsresource?objectid=161961&amp;type=PDF\"><span style=\"font-size:small;font-family:Times New Roman;\"><span style=\"color:#515151;\">Dutch report<\/span><\/span><\/a><span style=\"font-size:small;\"><span style=\"font-family:Times New Roman;\"><span style=\"color:#515151;\"> on file sharing showed, file sharing can even foster (the Dutch) economic growth in the long run.<\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:36pt;text-align:justify;margin:0;\"><span style=\"color:black;\"><span style=\"font-size:small;\"><span style=\"font-family:Times New Roman;\"><span style=\"color:#515151;\">Update April 30th 2009: Another <a href=\"http:\/\/www.aftenposten.no\/kul_und\/musikk\/article3034488.ece\">report<\/a> from r<span style=\"color:#000000;\">esearchers at the BI Norwegian School of Management shows that people who pirate the most from P2P sites are also the ones most likely to buy legit downloads. Of course there is some discussion about these findings, but the conclusions are interesting nevertheless.
